Terms

These terms are the licence agreement for Nota, a dictation app for macOS. They are between you and Bielfor LLC, a Delaware company (“we”, “us”), which makes Nota. By installing or using Nota, or by buying a licence, you agree to them. If you don’t agree, don’t install or use Nota.

1. Who sells what

Nota Pro is sold by Polar Software Inc. (“Polar”) as merchant of record and authorised reseller. Polar takes the payment, charges sales tax or VAT, sends the receipt and processes refunds. Its buyer terms cover the purchase itself. We are the licensor: your right to use Nota comes from these terms.

2. The free trial

Your first 5,000 words are free, with every model and feature and no time limit. Words you dictate and words transcribed from files both count. The word count is kept on your Mac. After 5,000 words, Nota stops working until you enter a licence key: no dictation and no file transcription. Your history, dictionary and settings are not deleted; they stay on your Mac and are there again when you enter a key.

3. What you buy

A Nota Pro licence is a one-time purchase, not a subscription. There are three tiers:

4. Your licence

We grant you a personal, perpetual, non-exclusive, non-transferable licence to use Nota on as many Macs as your tier allows, at the same time, for your own work, personal or commercial.

5. Updates for life

Your licence includes every future version of Nota, including new major versions, at no additional charge, for the life of the product. There are no paid upgrades.

7. Open-source components and models

Nota includes open-source software and can download speech models that come with their own licences. Those licences apply to those parts and are listed on Acknowledgements. Nothing in these terms limits your rights under them.

8. Cloud providers and your own API keys

Cloud speech and AI models are optional. To use one, you add your own API key from that provider (for example OpenAI, Groq, Deepgram, ElevenLabs, Anthropic or Google Gemini). Then:

9. Refunds

You can get a full refund within 14 days of purchase, no questions asked. See the refund policy.

If you are a consumer in the EU, the UK or another country with a statutory right of withdrawal for digital content, our 14-day refund applies even after you have downloaded Nota or activated your key, so you don’t lose anything by starting to use it.

10. No warranty

Nota is provided “as is”. Speech recognition makes mistakes; check any text that matters before you rely on it. To the extent the law allows, we disclaim all implied warranties, including merchantability, fitness for a particular purpose and non-infringement.

If you are a consumer, you keep the rights the law of your country gives you for faulty digital content. Nothing in these terms takes them away.

11. Limit of liability

To the extent the law allows, we are not liable for indirect or consequential loss, or for lost data, profits or business, and our total liability to you is limited to the amount you paid for your licence.

This does not limit liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited by law.

12. Ending the licence

The licence lasts as long as you follow these terms. If you seriously break them (for example, by reselling your key) and don’t fix it within 14 days of our email, we may end your licence. You then stop using Nota Pro. A refund also ends the licence (see the refund policy).

13. Export

You may not use Nota in a country, or as a person, subject to US sanctions or export restrictions.

14. Changes

We may update these terms, for example when Nota adds a feature or the way it is sold changes. We post the current version here with a new date. A change never removes rights you already paid for: your tier, the perpetual licence and updates for life.

15. Law and disputes

These terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-law rules. Please email us first; most problems are solved that way. If you are a consumer, you can also bring a claim in the courts of the country where you live, and you keep the protection of its mandatory consumer laws.
